Personer som inte \u00e4r bosatta i landet har dock inte denna m\u00f6jlighet. De m\u00e5ste betala skatten p\u00e5 sina kapitalvinster omedelbart vid tidpunkten f\u00f6r \u00f6verf\u00f6ringen av tillg\u00e5ngarna, utan m\u00f6jlighet till uppskov.<\/p>\n<h4>\u00d6vertr\u00e4delsef\u00f6rfarande<\/h4>\n<p>Den 2 december 2021 inledde EU-kommissionen ett \u00f6vertr\u00e4delsef\u00f6rfarande mot Spanien genom att s\u00e4nda en formell underr\u00e4ttelse. Eftersom Spanien inte har anpassat sin lagstiftning till EU:s krav har kommissionen nu beslutat att s\u00e4nda ett motiverat yttrande till Spanien. Detta \u00e4r en formell beg\u00e4ran till Spanien om att \u00e4ndra sin lagstiftning inom tv\u00e5 m\u00e5nader. Om Spanien inte r\u00e4ttar sig efter beslutet kan kommissionen g\u00e5 vidare med \u00e4rendet till EU-domstolen.<\/p>\n<h4>Konsekvenser f\u00f6r personer som inte \u00e4r bosatta i landet<\/h4>\n<p>Personer som inte \u00e4r bosatta i Spanien befinner sig f\u00f6r n\u00e4rvarande i en mer of\u00f6rdelaktig situation \u00e4n personer som \u00e4r bosatta i Spanien n\u00e4r de s\u00e4ljer tillg\u00e5ngar i Spanien och vill f\u00e5 avbetalningar. De nuvarande reglerna kan anses vara diskriminerande, eftersom de missgynnar personer som inte \u00e4r bosatta i Spanien j\u00e4mf\u00f6rt med personer som \u00e4r bosatta i Spanien.<\/p>\n<h4>N\u00e4sta steg<\/h4>\n<p>Spanien har nu tv\u00e5 m\u00e5nader p\u00e5 sig att reagera och vidta de \u00e5tg\u00e4rder som kr\u00e4vs f\u00f6r att anpassa sin lagstiftning till EU-r\u00e4tten.
