Sin embargo, los no residentes no tienen esta opci\u00f3n. Deben pagar el impuesto sobre sus ganancias patrimoniales inmediatamente en el momento de la transmisi\u00f3n de los activos, sin posibilidad de aplazamiento.<\/p>\n<h4>Procedimiento de infracci\u00f3n<\/h4>\n<p>El 2 de diciembre de 2021, la Comisi\u00f3n Europea inici\u00f3 un procedimiento de infracci\u00f3n contra Espa\u00f1a mediante el env\u00edo de una notificaci\u00f3n formal. Dado que Espa\u00f1a no ha adaptado su legislaci\u00f3n a los requisitos de la UE, la Comisi\u00f3n ha decidido enviar un dictamen motivado a Espa\u00f1a. Se trata de una petici\u00f3n formal a Espa\u00f1a para que modifique su legislaci\u00f3n en un plazo de dos meses. Si Espa\u00f1a no cumple, la Comisi\u00f3n puede llevar el asunto ante el Tribunal de Justicia de la Uni\u00f3n Europea.<\/p>\n<h4>Consecuencias para los no residentes<\/h4>\n<p>Los no residentes se encuentran actualmente en una posici\u00f3n m\u00e1s desventajosa en comparaci\u00f3n con los residentes espa\u00f1oles cuando venden activos en Espa\u00f1a y desean recibir el pago a plazos. Las normas actuales pueden considerarse discriminatorias, ya que perjudican a los no residentes en comparaci\u00f3n con los residentes en Espa\u00f1a.<\/p>\n<h4>Pasos siguientes<\/h4>\n<p>Espa\u00f1a dispone ahora de dos meses para reaccionar y tomar las medidas necesarias para adecuar su legislaci\u00f3n a la legislaci\u00f3n de la UE.
