Gebietsfremde haben diese M\u00f6glichkeit jedoch nicht. Sie m\u00fcssen die Steuer auf ihre Ver\u00e4u\u00dferungsgewinne sofort zum Zeitpunkt der \u00dcbertragung des Verm\u00f6gens zahlen, ohne die M\u00f6glichkeit einer Stundung.<\/p>\n<h4>Vertragsverletzungsverfahren<\/h4>\n<p>Am 2. Dezember 2021 leitete die Europ\u00e4ische Kommission ein Vertragsverletzungsverfahren gegen Spanien ein, indem sie eine f\u00f6rmliche Mitteilung \u00fcbermittelte. Da Spanien seine Rechtsvorschriften nicht an die EU-Anforderungen angepasst hat, hat die Kommission nun beschlossen, eine mit Gr\u00fcnden versehene Stellungnahme an Spanien zu richten. Dies ist eine formelle Aufforderung an Spanien, seine Rechtsvorschriften innerhalb von zwei Monaten zu \u00e4ndern. Kommt Spanien dem nicht nach, kann die Kommission den Fall vor den Gerichtshof der Europ\u00e4ischen Union bringen.<\/p>\n<h4>Folgen f\u00fcr Gebietsfremde<\/h4>\n<p>Gebietsfremde sind derzeit im Vergleich zu spanischen Gebietsans\u00e4ssigen in einer nachteiligeren Lage, wenn sie Verm\u00f6genswerte in Spanien verkaufen und eine Ratenzahlung w\u00fcnschen. Die derzeitigen Vorschriften k\u00f6nnen als diskriminierend angesehen werden, da sie Gebietsfremde im Vergleich zu Gebietsans\u00e4ssigen in Spanien benachteiligen.<\/p>\n<h4>N\u00e4chste Schritte<\/h4>\n<p>Spanien hat nun zwei Monate Zeit, um zu reagieren und die erforderlichen Ma\u00dfnahmen zu ergreifen, um seine Rechtsvorschriften mit dem EU-Recht in Einklang zu bringen.
