Ikke-residenter har dog ikke denne mulighed. De skal betale skat af deres kapitalgevinster straks p\u00e5 tidspunktet for overf\u00f8rslen af aktiverne uden mulighed for uds\u00e6ttelse.<\/p>\n<h4>Overtr\u00e6delsesprocedure<\/h4>\n<p>Den 2. december 2021 indledte Europa-Kommissionen en traktatbrudsprocedure mod Spanien ved at sende en formel meddelelse. Da Spanien ikke har tilpasset sin lovgivning til EU&#8217;s krav, har Kommissionen nu besluttet at sende en begrundet udtalelse til Spanien. Dette er en formel anmodning til Spanien om at \u00e6ndre sin lovgivning inden for to m\u00e5neder. Hvis Spanien ikke efterkommer dette, kan Kommissionen indbringe sagen for Den Europ\u00e6iske Unions Domstol.<\/p>\n<h4>Konsekvenser for ikke-hjemmeh\u00f8rende<\/h4>\n<p>Ikke-residenter er i \u00f8jeblikket i en mere ufordelagtig position sammenlignet med spanske beboere, n\u00e5r de s\u00e6lger aktiver i Spanien og \u00f8nsker at modtage betaling i rater. De nuv\u00e6rende regler kan betragtes som diskriminerende, da de stiller ikke-hjemmeh\u00f8rende ringere end indbyggere i Spanien.<\/p>\n<h4>N\u00e6ste trin<\/h4>\n<p>Spanien har nu to m\u00e5neder til at reagere og tr\u00e6ffe de n\u00f8dvendige foranstaltninger for at bringe sin lovgivning i overensstemmelse med EU-retten.
